This policy applies to and provides information held about clients and prospective clients, suppliers and prospective suppliers, artists, contacts and all other persons about whom we hold information. By ‘information,’ we mean personal information about you that we collect, use, share and store.
In this policy, “we,” “us,” and “our” means www.loughercontemporary.com and “you” means the individual to whom the information relates. Additionally, “website” means www.loughercontemporary.com.
The website is owned and managed by and on behalf of Lougher Contemporary Ltd who is the “Controller” pursuant to the Data Protection Act 2018.
It is important that you read this privacy policy so that you are fully aware of how and why we are using your data. It is also important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.
What we collect
• Your name;
• Your contact information such as your address, email address and telephone number;
• Your username and password (if relevant);
• Technical data including internet protocol addresses, login date, browser type and version, time zone, browser plug ins, operating systems and other technology on any device you use to access the website;
• Your payment details/financial data i.e. your bank name, account number and sort code;
• Your order and related orders:
• Information related to your preferences as well as attendance of, and interest in, art that is included on our website or related to artists shown thereon, any events that we may put on and art fairs where we are in attendance;
• Information about you that you give us in person at our events and art fairs, by filling in forms on our website (e.g. to sign up to our mailing list) or by corresponding with us by phone, email or otherwise; and
• Information in relation to your purchase of artwork or use of our services.

We do not knowingly collect information about minors.
What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
How we collect information about you
• Directly, if and when requested by us;
• Information you give to us for a specific purpose e.g. when you purchase any artwork or visit us at an event or art fair;
• Automated technologies or interactions e.g. we will automatically collect technical, profile and usage data about your equipment, browsing actions and patterns;
• Third parties such as any know-your-customer service provider we use in connection with the AMLRs;
• Website and in gallery sign-up requests.
What we do with the information we gather
We use your information to:
• Provide information about our artwork and services to you;
• Keep you informed about artwork, artists and events that we think you may find interesting;
• Carry out our obligations arising from any agreements entered into between you and us;
• Communicate pro-actively with you;
• Keep our site safe and secure;
• Comply with legal and regulatory obligations; and
• For security and to check your identity.
Legal basis for processing
Our processing of your personal information is necessary for the following reasons:
• For the performance of contracts to which you will be a party to and in order to take steps at your request prior to you entering into those contracts;
• For the purposes of legitimate interests pursued by us; or
• In order to comply with a legal obligation to which we are subject.
In relation to any processing of special categories of personal data, we will rely on obtaining specific consent from you at the time unless there is otherwise a legal requirement for us to process such information.
Legitimate interests
Our processing is, based on the above (i) to provide you with a smooth and efficient client experience; (ii) to make sure you receive updated information on Lougher Contemporary’s business and related activities as well as that of other artists referred to on the website; (iii) to provide the services you have requested which includes monitoring trends ; (iv) for our own marketing and research; (v) to administer and protect our business and our software including troubleshooting, data analysis and system testing
Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data.
We may also collect and share aggregated data. This is not considered personal data as it will not directly or indirectly reveal your identity.
Sharing your information
Except as expressly set out in this policy we will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.
Notwithstanding the above, the personal information you provide to us may be shared with third party companies, agents, contractors, service providers or affiliated companies if this is necessary to provide you with our artwork or services, respond to your inquiries or for any of the purposes described in this policy. For the avoidance of doubt, this includes providing personal data to any third party that provides banking and/or payment services to us in relation to any services that you have asked us to provide to you;
We may also share your personal information with:
• Law enforcement agencies, other governmental agencies or third parties if we are required by law to do so; and
• Other business entities should we plan to sell, transfer or merge parts of our business or our assets with or if we are to be acquired by that business entity, or if we undergo a re-organisation with that entity. Accordingly, if a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.
Transferring Your Information outside the UK
Your personal information may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”) and may also be processed by staff operating outside the EEA who work for us, or for one of our service providers.

• To data portability (moving some of your personal data elsewhere) in certain circumstances;

• To not be subject to a decision based on automated processing and to have safeguards put in place if you are being profiled based on your personal data.
Any request from you for access to or a copy of your personal data must be in writing, and we will endeavour to respond within a reasonable period and in any event within one month in compliance with data protection legislation. We will comply with our legal obligations as regards your rights as a data subject. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
Marketing
Where you are one of our clients or have otherwise agreed to be contacted for marketing, we may use your personal information to send you information about our events, art fairs and works of art.
You can unsubscribe from receiving them at any time. If you no longer wish to receive our correspondence, you should notify us in writing at art@loughercontemporary.com.
We will action any opt-out request from you promptly.
How long will we keep Your information?
We will only keep the information we collect about you for as long as required for the purposes set out above or as required to comply with any legal obligations to which we are subject. This will involve us periodically reviewing our files to check that information is accurate, up-to-date and still required.
Where we are permitted to send you direct marketing communications, we may retain your contact information necessary for this purpose, for as long as you do not unsubscribe from receiving the same from us. If you opt out from marketing, we will retain your information to enable us to respect your wishes to not be contacted for marketing purposes.
Security
We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

Fees
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

How we use cookies
